Robert Murat was born Robert James Queriol Eveleigh Murat, at Queen Charlotte’s Hospital in London, on 20 November 1973.

His mother is Jennifer Ann Murat, nee Eveleigh. Born in 1936.

Father was John Henry Queriol Murat, was born on 24 January 1924 and died in Westminster, London, in 1986.

Police investigating the abduction of Madeleine McCann yesterday spent a second day digging up the garden of Robert Murat, the only official suspect, at his home yards from where she was abducted.


The search continued while Kate McCann, Madeleine's mother,
spoke of her regret at leaving her three children alone at the resort
while she and her husband ate at a nearby restaurant.






Intense police activity in the past 48 hours has sparked
hope of a breakthrough, more than three months after Madeleine went
missing.

It is claimed that two sniffer dogs from Britain and
their police handlers have found new clues at the apartment in Praia da
Luz where she disappeared.

Last night the focus of the inquiry remained on Casa
Liliana, which Mr Murat shares with his elderly mother. The home is 150
yards from where Madeleine was snatched on May 3.


As many as 10 officers spent Saturday clearing thick vegetation. Sniffer dogs inspected the premises.

It is thought detectives used scanners that can detect anything buried deep beneath the ground.

Mr Murat, 33, has been the only official "arguido", or
suspect, since May 10, when he was detained by police. He was questioned
for a second time last month but detectives have never found any
evidence to arrest him formally.

He was on the premises yesterday and has told friends he
welcomes the search, which he believes will reveal nothing except his
innocence.

Police remained silent over why they had searched Mr Murat's home a second time.

"We have reached a phase in the investigation where we are trying to evaluate everything," one Portuguese police source said.

"We are going through all the interviews, facts and clues -
with the help of British profilers - to ensure nothing has been missed
or left out. At the moment there is still only one arguido."

Police are yet to resolve alleged inconsistencies in statements given.

Friends of the McCanns said they saw a man near the family's apartment helping with the search on the night Madeleine vanished.

Mr Murat maintains that he was at home with his mother all evening when the girl was snatched from her bed.

In the first interview she has given without husband Gerry, Mrs McCann, 39, said: "We are just so desperately sorry.



"Every hour now, I still question, 'why did I think that was
safe?' If I'd had to think for one second, 'should we have dinner and
leave them?', I wouldn't have done it.

"It didn't happen like that. I didn't have to think for a second, that's how safe I felt."

She said she tucked Madeleine into bed that night, and her
daughter last words to her were: "Mummy, I've had the best day ever. I'm
having lots and lots of fun."

Mrs McCann also described her joy at the birth of Madeleine, her oldest child, after five years of trying for a baby.

She said: "I wanted to be a mother. Then, when we were trying for a baby and it wasn't happening, it was really hard.

"The longer it went on, the harder it was. I saw my friends
having children and I was really delighted for them, but it made me feel
sad, too. We tried unsuccessfully for several years to conceive.

"There came a point when we admitted we needed help. I was
so desperate to have a child I'd try anything. I know IVF isn't
everyone's choice but I wanted to try it.

"We had one unsuccessful attempt before Madeleine and that
was very hard. When I got pregnant with Madeleine it was just
fantastic."

Asked what message she would send to her daughter, Mrs
McCann said: "I would tell her that we love her. She knows we love her
very much. She knows we are looking for her, that we are doing
absolutely everything and we will never give up."

Mrs McCann, a GP, and her husband, a consultant cardiologist, from Rothley, Leics, are both on compassionate leave.

Meanwhile, Belgian police are investigating an alleged sighting at a café in Tongeren.

They are awaiting results from DNA tests on a milkshake bottle and straw used by a girl matching Madeleine's description.

One witness, a child therapist, said the couple were acting
strangely and the child seemed nervous. "It was obvious that the couple
were not her parents," she said.

The woman telephoned police but the trio left before officers arrived.

Brian Kennedy & Robert Murat

Why in heaven's name did Brian Kennedy, the multi-millionaire double glazing magnate who out of the goodness of his bountiful heart poured his energies and money into helping to find Madeleine (e.g. by appointing Metodo 3 and Kevin Halligen to help find her), take his lawyer, Freemason Edward Smethurst, to meet with the leading suspect in the case, Robert Murat, who was suspected of abducting or killing Madeleine. And why was Robert Murat's lawyer there?

Were they all on a mission to find Madeleine?

Or were they and their lawyers sorting out something very different and striking up some sort of deal, or even a contract?

N. Robert Murat’s meeting with Brian Kennedy in Portugal, 13 November 2007


We’ll now move right away from the events of early May 2007 and look at two meetings that were probably of great significance in this case that took place in Portugal in November 2007. One was between Robert Murat and Brian Kennedy, the multi-millionaire double glazing magnate who has effectively bankrolled the various private investigations which were supposed to be about finding Madeleine.


Others were also present at this meeting. He was also, as was made clear in John Whitehouse’s article on our website, the man who was at the centre of these intelligence operations, running them from a house believed to be in Knutsford, appointing the staff and directing them.

We now know that Brian Kennedy flew out in November 2007, about three weeks after this ’phone call, together with his in-house lawyer from the Latium Group, Edward Smethurst. This, briefly, is the Portuguese Police’s account of a meeting between them, Metodo 3, Brian Kennedy and Edward Smethurst. The date of it was probably arranged during or soon after the ’phone call of 19 October:

“We held a meeting on 13 November, with Inspectors Paulo Ferreira and Ricardo Paiva present, with Brian Kennedy, Director of the detective agency, Francisco Marco and one of his advisers, plus Antonio Jimenez, ex-chief of the Kidnapping Unit of Catalonia [Note: Other information suggests that Edward Smethurst was also present].

Brian Kennedy insisted that his motives were purely charitable, aimed at finding the truth, and generally helping missing children. He said he was interested in discovering the truth even if the McCann family, the friends, or any other person is found to be involved in the disappearance”.

Brian Kennedy’s involvement in the investigation into the disappearance of Madeleine McCann has been controversial. An article by Mark Hollingsworth in the Evening Standard in August 2009 claimed that “The involvement of Brian Kennedy and his son Patrick in the operation was counter-productive, notably when they were questioned by the local police [in Portugal] for acting suspiciously while attempting a 24-hour ‘stake out’.”

The ‘Evening Standard’ article also showed that, later, the relationship between Metodo 3 and the Portuguese police had ‘completely broken down’. Hollingsworth claimed that key witnesses were questioned ‘far too aggressively’ by Kennedy’s investigators, so much so that ‘some of them later refused to talk to the police’. Interference with witnesses to that extent could amount to a criminal offence.

We are not aware that any other nation allows people to interfere with potential witnesses in an investigation in such a way as to cause them to refuse to testify, as Mark Hollingsworth in his article claimed had happened in this case, due to Kennedy’s investigators.

It was Francisco Pagarete, Mr Murat’s Portuguese lawyer - the one whom he was so anxious to see when he flew out to Praia da Luz on 1 May - who confirmed that a second meeting involving Brian Kennedy took place at Mr Murat’s uncle’s house in the Algarve in November. He told the BBC: “[Brian Kennedy] came here to give his support to Robert and to say he doesn’t believe Robert was involved in this story in any way or sense. And he asked if Robert could help the investigation for the finding of Madeleine in any way”. Mr Pagarete added that Mr Kennedy had ‘promised to stay in touch with Mr Murat’ but ‘had not contacted him since’. Mr Pagarete also confirmed that Edward Smethurst was at the meeting.

The Portuguese paper Jornal de Notícias appeared to have some additional information about this meeting. Their report, early in 2008, said: “The meeting - a dinner that Brian Kennedy asked to be discreet and far away from the eyes of the press - took place in the end of last year at a house of Murat's relatives in Burgau (Vila do Bispo). At the dinner were Robert Murat and Kennedy, their respective lawyers, Jennifer Murat and the aunt and uncle of Murat” [NOTE: This appears in fact to have been Ralph Eveleigh, Murat’s uncle, and Sally Eveleigh, his cousin].

If Murat and Kennedy each had one lawyer with them - Pagarete and Smethurst - that makes seven people present at that dinner in Burgau: Murat and his mother, his uncle Ralph and cousin Sally Eveleigh, who ran the 8-room guest house at Vila do Bispo, two lawyers and Brian Kennedy.

What was discussed at this meeting that Kennedy didn’t want the press to know about?

This evening meeting was either on the same day, or very close to, the meeting that Brian Kennedy had with the Portuguese Police on 13 November 2007 that we referred to above. The two Portuguese Police Inspectors, Ferreira and Paiva, later submitted an account of their strange meeting with Brian Kennedy.

The report, which is amongst the documents contained in the police files, indicates that right at the start of the meeting, Brian Kennedy was keen to stress that his intentions were ‘purely charitable’, because he felt ‘concerned about cases of child neglect and child abduction’. The Director of Metodo 3, Francisco Marco, presented information to the PJ about three situations, allegedly received via their ‘hotline’.

The first of these concerned an incident that the British media had already referred to, at the end of October 2007: a woman who had been baby-sitting at the Ocean Club, in Apartment 5A in August/September 2006, said she spotted a man ‘hidden in the shadows’, the same day that Madeleine disappeared. A story about this had surfaced in the Sun on October 31.

According to the newspaper, “The nanny - identified only as M.H. - reported the frightening incident to the police in England after the hunt for Madeleine started in May, but did not speak to the police in Portugal”. Clarence Mitchell added that: “This evidence supports what we have always said, that Maddie was taken from her bed by an abductor”. The Portuguese Police had however ruled out this report, because the detectives considered that there was no proof that it was in any way related to Madeleine's disappearance.

The second piece of information was about the alleged existence of images of paedophilia on a computer at the home of Sergei Malinka, witnessed by the fiancé of a British woman, four years ago, when he was at Malinka's house. According to this witness, he questioned Malinka on the subject and he explained that the computer belonged to a client and that he would report it later to the authorities. All of the computers at Malinka's house were seized and examined, but the Portuguese Police report said that nothing of any relevance or suspicion was found.

The third piece of information referred to a detailed witness statement, according to the Metodo 3 report, about a woman handing what the witness was convinced was a child, wrapped in a blanket or a sheet, over a fence to a man, next to two parked vehicles, near a town 100 miles from the Algarve. The witness, a Portuguese lorry driver, M.G., looked at several photos and picked out Michaela Walczuk [Robert Murat’s girlfriend, now his wife], saying that her picture was the one that most resembled the woman he had seen.

The British media published a version of this story on 19 November 2007, but with different details. The METRO free paper boldly wrote: “A witness spotted Murat's German girlfriend, Michaela Walczuch, in a car with Maddie, on 5 May, in central Portugal”. On the same day, the Daily Mail published a similar story: “According to a source, a new witness identified Michaela Walczuch as the woman seen with the missing child, in central Portugal, 160 kilometres [100 miles] from where she disappeared on May 3rd”.

As usual, Clarence Mitchell had a few things to say to the media: “We are not going to comment on any line of the investigation except to say that we are encouraged by the fact that our investigators seem to be making progress. Kate and Gerry are not ruling out any possibility”.

The Portuguese Police studied this incident and questioned the Portuguese lorry driver, but the facts that he described to the police were somewhat different to those reported in the British press. The lorry driver said he saw a woman handing something to a man, over a fence, wrapped in what looked like a blanket. It wasn't heavy, because they did it easily and the fence was around 1.6 metres high (5 feet). Asked if it could have been the body of a child, he responded that nothing he had seen would indicate that.

Questioned also about the positive identification of Michaela Walczuk, according to Metodo 3's report, the witness told the Portuguese Police that he couldn't see the woman's face, because he was driving his lorry at 45/50 mph, and the couple were at some distance. He only chose Michaela's photo from amongst the others Metodo 3 had shown him because she had the same hair colour and similar build.

The actual facts which emerged from the lorry driver, then, did not seem anywhere near sufficient to justify the press headlines claiming that he had positively identified Murat and his girlfriend.

The other meeting was between Brian Kennedy, the Portuguese Police, and the Spanish private detective agency recently chosen by Kennedy and the McCanns: Metodo 3. This took place in police headquarters in Portimao.


A report from the Portuguese Police referring to a ’phone call on 19 October, gives us some background; here it is:


On the 19th of October, we were contacted by Alberto Carbas, Chief of the Kidnapping Unit of the Commissary-General, based in Madrid, who passed to us the information that the McCann family had contracted a Spanish private detective agency known as ‘Metodo 3’. The costs of their investigation into Madeleine McCann were being covered by a Scottish multi-millionaire whose name is Brian Kennedy. His objective was to find Madeleine.


“We were asked if we were available and interested in meeting with a representative of Metodo 3 and the Spanish Commissary General and Chief of the Kidnapping Unit of the Police in Spain. The purpose of this proposed meeting, they said, was to find out the truth, but they stated that they would not interfere in police work. At most, they said, they would ‘complement’ our investigation. They firmly stated that they are not working directly for the McCann family, but for Brian Kennedy. They didn’t ask for any information regarding the investigation, nor was any offered to them, for obvious reasons”.

Robert Murat - 5 actions being taken against 5 Portuguese media outlets.

From the Público newspaper article there are 5 actions being taken against 5 Portuguese media outlets. Confirmed by Pagarete, Murat's lawyer there is a criminal action, at inquest phase and under judicial secrecy, against Jane Tanner. As per the Daily Express, three other Tapas members are also being a target of a criminal complaint.

So, really confirmed by Murat's lawyer there are 6 actions, one against JT and 5 other, which we don't know if they are separated or jointed, against 5 different Portuguese media outlets. That is all that we know as confirmed.

The 3 other Tapas, though printed in the Express article, might be or not also a target of a complaint, however given that on the second Público newspaper article Pagarete states:«Why did the McCanns’ three friends lie, saying that they had seen him there [Ocean Club] on that night”» we can assume that those three persons are likely being also a target of criminal complaint for calumny, like Jane Tanner.

She confirms being the mother of arguido Robert Murat, and is willing to make this statement.

--- She comes to the case as a witness.


--- The deponent is the mother of the arguido ROBERT MURAT and therefore was advised of the conditions of Art 134 and following of the CPP, she wished to make a statement to better clarify the facts and thus contribute to the discovery of the truth.

--- The deponent is English, having settled in Portugal for 40 years and therefore understands, reads and speaks Portuguese without difficulty.

--- Concerning the events, the deponent has to clarify that she knew [found out] about the disappearance of the English child called Madeleine on 4 May, Friday, that is the day following it happened.

--- She says further that it was her daughter, Samantha, residing in England in the city of Exeter, who telephoned her to give her the news because by the morning our news was already running in the press of that country.

--- She states that her daughter's phone number is 00441932****38 and her mobile is 0044781*****42.

--- Relative to her life in Portugal, she states that she came to live in this country in 1968/69.
--- She had contact with the Algarve in 1959/60 by virtue of her late husband having bought a small house in Burgau.

--- It was only later they decided to settle in Portugal the husband, John Murat, having started a property business.

--- Thus they maintained themselves during the time until 25 April 1974 which began a big crisis in the property business obliging her to start work in the Lagos Hospital, as a nurse (her original profession).

--- She is mother to three children, Richard (28), Samantha (36) and Robert born on 20 November 1973.

--- Robert, the same as the other children, was born in England, in London.

--- About one month old he came to Portugal to live with the family in Atalaia in Lagos.

--- The son Robert started his schooling in the Barlavento School (English school) where he did his primary education.
Later he was enrolled in the International School where he continued to study for a further two years.
Later on he enrolled in a public school in Lagos where he studied until he was 16 years old at which time he travelled to England to be with his maternal grandmother.

--- There he started to work in a firm that sold double-glazing. He worked also as a car salesman for “Nissan”.

--- He was in England for more than 10 years, always in Norfolk. Furthermore it was in that city that he met the woman whom he later married.

--- In those 10 years he was in England, Robert came to Portugal several times, perhaps three time a year, roughly.

--- Asked, she says the is not certain on which date Robert was married but she knows that his wife in English and 10/12 years older than him and she knows only that her name is Dawn.

--- From this marriage came a daughter, Sophie or Sofia (she is not certain), who was currently four years old and who was born in October 2002, living with her mother in Norfolk [full address given].

--- Robert's wife already had a son, David, from a first marriage who was over 20 years old and who also went by the name Murat while his mother and Robert were married.

--- The marriage ended in 2003 though the deponent does not know if the divorce was ever finalised. She knows, moreover, that her son Robert maintains a good relationship with his ex-wife, with his daughter and with David.

--- [When] Robert travels to England he always stays in a house inherited by the deponent, which is being 'renovated' and which is in Sidmouth, Devon.
 Robert is dealing with that situation and she knows that when he is there his daughter will be found with him.

--- It is a semi-detached house, vacant since 2003 ((the date of death of the maternal grandmother), and is situated exactly at [address given], Sidmouth, Devon

--- Returning to the family history in Portugal, more or less in 1981, the witness and rest of the family, including the three children, left Atalaia and went to Almadena, more specifically to a property called Eiras Velhas.
It was a property of just over two hectares, which included several houses in ruins.
 These were rebuilt and the property served as the family address until 2002, when it was sold.

--- During the almost 20 years that the witness lived in that property in Almadena, they used the house for rural tourism which consisted of renting rooms to tourists.
She notes that that business was always legal, having a license for it.

--- Robert lived with the family for several years in that house and later, after opting to go to England, he was always accommodated in the family home when when he returned to Portugal.

--- In 2001, the witness sold the property in Almadena and bought the house where she lives now. It is “Casa Liliana”.

--- Initially she came to live in "Casa Liliana" accompanied by a friend (they had a companion relationship after being widowed), who currently resides in France.
Later came the mother of the witness who lived there until her death in 2003 at the age of 93 years.

--- The companion of the witness, currently in France, never had a close relationship with Robert nor with the witness’ other children.

--- Still in 2003, Robert came to Portugal with his wife DAWN and daughter, who was a baby, and stayed for about two months.
 At that time they had the idea to settle here.
However, his wife did not adapt because of the language and the fact of being away from family and friends.
So, she finally left Robert and returned to England with her daughter.

--- Robert began to work in the business of real estate having been initially with "Remax" then with "Portuguese Homes," having returned later to "Remax".
The failure of the employers to pay, or the difficulty in receiving his rightful commissions, led Robert to start a project, a property business through the Internet, teaming up with a friend called M1CHAELA.

--- The witness knows Michaela, knows she has a daughter who she knows only as "Titinha", who is about 8 or 9 years old, is a Portuguese national, and lives in Lagos.
She knows that Michaela is still married to an individual named Louis and she is a Jehovah's Witness.

--- Asked, the deponent refers that she does not know if her son Robert maintains a relationship with Michaela it being certain that she never slept in her house.

--- Asked, she clarifies that she never knew of any loving relationship of her son beyond that with his wife Dawn.
She asked her son never to bring anyone home to “sleep”. That is not to say that her son had had no relationships.

--- About the son Robert, she knows only of a health problem that resulted in the blindness in the right eye.

--- Maybe when he was about 9 years old, the witness noticed that he had a small disorder in his vision having taken him to several specialists.
 He was diagnosed with dislocation of a retina, of traumatic origin, that was not corrected after being operated on. It left the right eye unusable.

--- She also knows that he has an hereditary thyroid problem.

--- She does not know of any other physical, psychiatric or dysfunction problem.

--- Asked, the deponent says that she has the idea that her son had been hospitalised only once, specifically for the problem with his sight.

--- That said, when he was about ten years old, Robert had a small injury to his knee, of unknown origin, having led to surgery in the United Kingdom.

--- She does not know if that physical problem led to Robert being admitted.

--- The question asked, she says that to her knowledge, Robert takes only one medication on a regular (daily) basis, a drug called 'Letter"or "Levothyroxine", specifically for the thyroid problem which, as already said, is hereditary.

--- Relative to the facts concerning the disappearance of the English child, the deponent states that because she has been in Portugal for a long time and knows many people, she decided to mount a "post" to collect information in order to be able to determine things about the subject and thus could channel them to the competent authorities.
For three days (Friday 11/05, Saturday 12/05 and Sunday 13/05) she was at the "post" mounted near to the cinema having obtained some information that she gave to Robert who, in turn, gave it to the Police.

--- Her idea was to try to sensitise people not to feel intimidated by the presence of police and lead them to give all the information that they knew.

--- Still relating to the facts which occurred on the evening of 03 May 2007, the deponent states that on that night she was at home with her son Robert.
They followed their normal routine:
About 19h50 she went to the "Batista" supermarket to buy bread.
Then she went back to the house where she arrived more or less at the same time as Robert.
Later they sat in the kitchen where they were talking for some time, having also eaten.
She recalls that they were talking until close to midnight about Robert’s project, related to the property and called “Romigen.Com".
Finally they went to their bedrooms to pass the night.

--- Asked, she explains that while they were talking in the kitchen, she is not able to say when, she recalls having heard a siren ringing at least once.
Although not usual, she also did not "connect" because it could possibly have been an ambulance.
(She recalls that sometimes, when the wind blows in a certain direction, it is possible to hear in the house sirens of police cars or ambulances that pass on the EN125).

--- Questioned, she says that during that night she also heard no noise or strange movements of people and also no one knocked on the door to ask or to request help to find the missing girl.

---Asked, she assures that her son Robert did not leave the house that night.
Furthermore, she says that he usually gets up first. On that day she does not remember if that was what happened.

--- Asked, she explains that Robert travelled to England on March 20 and returned on May 01, 2007, at 09h40, she herself having gone to the airport in Faro to collect him.

Asked if he wanted to respond on the facts that are imputed against him, he responded:

---- Yes, he intends to continue to answer the questions that will be put to him.

---- Relating to the listing of phone numbers obtained from the agenda of his mobile, that was present yesterday with him, he remembers now that the numbers for Roger 447... and 447... are mobile phone numbers of two partners who buy and sell land with whom he is related professionally.

---- Asked he says that before the events under investigation in this inquiry he was in England for about a month, carrying out the reconstruction of the house that was previously his grandmothers and is now his mothers.
He made this trip at the request of his mother, given that they had agreed that he would carry out the repair in exchange for his mother investing in Romigen.

---- The trip, as well as all the money used in reconstruction, were the costs of his mother.
---- While in England he basically associated with his relatives who reside near there, the sister, the brother-in-law, the nephews, as well as with his friend of long-standing M.R.C. (Checo) who also resides in the area (Exeter).

---- There the defendant lived in the house of his mother.
During his stay in that place he continued to make contacts, via the Internet, with the future partners Jorge Sxxxx and Jason, as well as with Michaela.

---- Questioned he affirms that he does not remember for certain if he contacted in that way, or any other, Sergey Malinca, he being sure that that, in doing so, such messages or contacts with Sergey are kept on his computer given that he does not remember having deleted anything off the computer.
The computer that he used in England is one of those that were subsequently seized during the search carried out at his home.

---- During the contacts that he made with the future partners it happened that the negotiations stalled.
Therefore he decided to travel to Portugal to try to progress that matter because he believed that that could only be done personally.

---- He made the travel reservation to Portugal for 01 May.
 This reservation was made through the Internet, having used the site

---- Questioned he answered that the reservation was made exactly for 01 May, being sure that he did not anticipate/advance nor anticipate/advance such a reservation.

---- The night before the trip he slept in his brother-in-law Steve's home, where his sister and nephews also were.

---- He recalls that the flight that brought him from Exeter to Faro airport was in the morning, and it was his sister Samantha who drove him to the airport.

---- Questioned he affirms that during his stay in England he did not contact with any of the people who he later came to find here in Portugal, namely those who were involved in the disappearance of Madeleine.
He is not aware that any of his family has made any contacts or know any of those people, namely anyone close to the McCann couple.

---- Having been asked for the record if on the night that Madeleine disappeared he was in the Ocean Club helping in the searches and in contact with several people, about 23h30 to 24h00, the defendant replied categorically that he was not.
He affirms that he was not on that night helping in searches given that, as he had stated he did not leave the house from 19h30 on 03 May until the morning of 04 May.

---- For the record, at 12:00 noon, this interrogation was interrupted in order to proceed with an interview of confrontation between the defendant and witnesses RACHEL MARIAMMA JEAN MAMPILLY, RUSSEL JAMES O'BRIEN, and FIONA
ELAINE PAYNE, the competent document having been drawn up.

---- After that diligence and for the record, 12:40, this interrogation is interrupted to continue opportunely.

---- At 14:30 the present interview was restarted.

---- Questioned the defendant reaffirms that in truth on the afternoon of 03 May he arrived at Casa Liliana around 19:00/19:30 having left the VW stopped in front of the house, that is outside the property, immediately entering into the property.
Questioned he does not remember the clothes he was wearing at the time.
Nor does he remember if his mother was at home or not.
Nor does he recall in detail what he did.
He remembers that at one time he spoke with his mother, however he cannot recall whether she arrived meanwhile or she was already there.
He remembers that they were sitting in the kitchen and the defendant remembering that he ate, how long with his mother he does not remember.
Confronted with the testimony of his mother who told that she arrived at the house around 20.30 and that Robert had also arrived at that moment, he says that he cannot account for having arrived at the same time as his mother.

---- Questioned he says that when he heard the sound of a siren he was with his mother in the kitchen, still talking, it would be about 22:00/22:30, the time he estimates taking into account that they had the television on.
Questioned he said not to recall if the sound was continuous or discontinuous.
He remembers only that at that time there was the sound of voices from both their talk and the sound of television, not recalling other sounds in the background.
He remembers well having heard that sound given that after it he commented to his mother that it seemed that he was in her house in England given that there he assiduously heard the sound of sirens.
He was not aware of other noises namely raised voices or the dogs barking outside the property.

---- Questioned about if he considers it normal or abnormal the fact of not having made nor received calls on his mobile phone between 15:00 on 02 May until the night of 03 May he said that that fact seems normal to him since in that period of time he had been accompanied by Michaela she being the person with whom he usually speaks to on the phone.
However, he states that he had assumed no purposeful position [given no thought to] that that fact had happened.

---- Questioned he states that he rented a grey Hyundai car on Saturday, 12 May, from the Auto Rent firm in Praia da Luz.
He thinks that he picked up the car in the afternoon of that day.
This car was returned by his mother on Tuesday 15th of that month.
Basically he used the car in the area of Lagos and Portim�o.
He did not leave the Algarve with it.
He does not remember how many kilometres he drove with the car, however he estimates about 100 to 200 at most.
He informs having rented it because his mother was using the VW in the information table [she had set up] and the Skoda was in the workshop and he had no other means of transport.
Confronted with the fact that there is information that the car had done 700 km during the rental period, he says this is not true.
He denies having gone so many kilometres in that car, adding that to have more mileage than what he indicated that this will be an error of whoever read the mileage [odometer], the defendant was the only person to use the car.

---- Questioned he says that never in his life has he entered the apartment where Madeleine was when she disappeared, neither before nor after the events under investigation.

---- Questioned if he knows anyone who is the owner of a boat he said that his uncle has a boat stored in the back of his property but that is on land.
 Last year, when he worked in Remax, he sold an apartment to an English man that he knows is the owner of a boat, but does not know however where this boat would be, nor had he ever seen it.
His relationship with this person was strictly professional.
There is also a friend of Luis, the husband of Michaela, whom he thinks is called Steve and that he said that he has a boat.
The defendant has never seen that boat nor does he even know if that is true or not.
He has no contact with this person.
Nelson Pxxxxxx, who is in his mobile phone address book, is the son of a man called Carlos Pxxxxxx who is the owner of a vessel that the defendant however never saw nor knows where it is.
---- Asked if on the day of the disappearance of Madeleine or in subsequent days he was in any marina or in any port, he said no, that he was not in any of those places on those days.

---- For the record, the defendant having been shown a photograph in which one can observe the defendant speaking with an individual on '25 de Abril' road, in Praia da Luz, he said that such person is one known to him, a resident of Praia da Luz, who knows Robert, and that he knows him to be of Romanian nationality.
He met this individual on an occasion in which he, the Romanian, did some gardening work at Casa Liliana, which he thinks was contracted by his mother.
The contact that happened when they were photographed was based on a request that the defendant [should be: the Romanian] made to Robert in the sense of him [RM] making a translation of an appeal in the Romanian language regarding the disappearance of Madeleine.

---- Asked about if at any time he had used used computers in the cyber caf�s either in Praia da Luz or in other places he responded negatively, that is, he had never used computers in those locations.
He affirms further that [n]either Michaela [n]or Sergey also [n]ever did so in the presence of the defendant.

---- For the record the defendant was asked if he has had conversations wit any person, besides his lawyer, about the way he could prove his innocence, be it personally, be it by telephone, be it in caf�s, or in any other place, conversations that could conflict with police techniques to prove the guilt or innocence of a person.

---- For the record the defence attorney requested some time to explain the question to the defendant and he was permitted a short break in order for them to converse.

---- Resuming the interrogation the defendant said yes he had spoken about this subject but he did so primarily with the family and with intimate friends.
In particular he states that he remembers having spoken with Inspectors of the PJ on an occasion at his home when he asked them if they could, through the antennas of mobile phones, prove that he was at home at a given moment, to which they replied that it would be possible but that he should not be concerned about it because that matter was going to be handled.
Questioned he responded that he thinks he had not asked anyone else.

---- For the record it being asked of him if he knows a British police officer by the name of Phill, he answered yes.
 It also being asked of him if he had not asked this British police officer about the method that British police had to locate a person in a particular place and at a particular time, he said yes.
Asked if that conversation was had on a personal level [in person] or by phone he responded that it was personal [in person].
 For the record the transcript of of the telephone intercept recorded on pages 1681 to 1690 being shown to him, he states for the record that effectively he continues to not recall having telephoned Phil nor having spoken with him on the phone, although he does recall a
conversation that he had with this individual at the home of his aunt, perhaps in the bar, repeating it in the following manner:
He had asked Phil if the Police could locate him in the house through the mobile phone to thus prove his innocence.
Phill had replied that such would depend on the distance from the antennas [masts], namely their active radius.
 It being asked of the defendant if he had or had not asked [Phil] if he, the defendant, could be located to within a distance of one meter of the place where he was, he responded yes.
 It being looked for from him the reason for such a question when his home, without the adjacent land, is about 300 square meters not justifying, perhaps, that he had asked the question about the location of the defendant within a meter, unless the defendant had been elsewhere, he did not respond.
 It being asked of him for what reason he resorted to a British official given that he had already said previously he had good relations with the PJ and GNR, he said that when he asked officers of the PJ it was done to know if that technology was already in the possession of the Portuguese police.

---- He states not remembering if after that contact he had had any further [contact] on this matter with whomever that was.

---- Asked if later on that he had given an account that the PJ him/it would be, like him defendant, later [following], what the procedure that he/it adopted.
 He responded that he ended by noting [taking note of] the licence plate of a car and that an officer of the PJ, named Reis Sxxxxx, said to him that the car would not belong [pertain] to this corporation.
Questioned he said that all the contours [outlines] of this circumstantialism [all pertinent circumstances] were revealed to Michaela and possibly to other people, either by phone or in person.

---- Having read the statements the defendant intended to clarify that when he refused to answer the question that was put to him on lines 128 and 129, he did it on the advice of his lawyer.

---- The next day the conversation he had with Phill the defendant was again at the home of his aunt where he found Phill and that he said to the defendant that he could not speak more with him about this case given that he was informed by his superiors he could not do so.

---- Yes, he intends to respond to the questions that are going to be put to him.

---- Despite having British nationality he understands perfectly the Portuguese language both spoken and written therefore the presence of a translator is not necessary in this interview.

---- Asked if he confirms his previous testimony he responded that because on the day the interrogation was conducted he was very tired and does not remember exactly what was said at that time, that is he recalls in general terms what he said, but does not remember the detail of some statements.

---- His previous declarations having been read to him he confirmed having made them, however it is his wish to amend some of affirmations that were made then [at that time] as he had confused some events, in particular in what he said with respect to the dates and times of what happened.
He stated events that he said had happened on Wednesday 02 and that now he more calmly recalls them having happened on Thursday and vice versa.
There are also other events that he now recalls happened in those two days in particular that he wants to disclose.

---- Further in what he said with respect to the days before and those subsequent he confirms the facts reported in the previous interrogation, giving them as if fully reproduced for this present interview.

---- He intends to clarify that when he stated having lived at various locations in England, instead of Norfolk, Devon - Sidford and Norwich he would like to say Norwich, Norfolk, that corresponds to the house where he lived with his ex-wife, Dxxx, his daughter Sxxxx and his adopted son Dxxxx, namely in the locality of Hockering ... Norfolk, and when he
said Devon Sidford he would like to say Sidmouth, Devon which corresponds to the house previously of his grandmother, now owned by his mother, located in Sidmouth, Devon, Ex..., it being that the Ex corresponds to the post code of region's principal city which is Exeter, located about 20 km from the town of Sidmouth.

---- He intends to clarify that he has no accounting qualification.
In truth when he worked in car sales firms, called INCHCAPE and NISSAN, in Norwich, he attended professional training courses aimed at the sales sector.

---- He clarifies that when he said that after the death of his father he returned to Portugal, he would like to say that he returned to England because on that occasion [at that time] he was living with his mother in Portugal.

---- He wants to clarify that now he is already divorced from Dxxx since 04 July 2007.

---- He states that when he travels to the United Kingdom he is housed in the home of his sister Sxxxxxxx MURAT, or in the home of her boyfriend, both mentioned in the previous record of the interrogation, or in the house that was previously their grandmother's, now deceased.

---- He wants also to clarify that in fact Michaela accompanied him three times to the United Kingdom and her daughter, Cxxxx Sxxxx Walczuch Ant�nio, only accompanied them once, namely at the time of Christmas of 2006.

---- The trip to the United Kingdom that he intended to make on 09 May was based on the fact of him having booked there a medical consultation and he intended to stay in the house that was previously his grandmothers.

---- The defendant intended to clarify that on the morning of 02 [May] he did not leave the house by 10:00-10:30, as stated previously but in fact he had met with Sergey Malinca on 02 [May], Wednesday, in the Baptista supermarket, at 10:00, he having arrived 15 to 20 minutes before and accompanied by Michaela whom he had gone to collect at her home in the VW.
They talked about the Romigen web site that Sergey was setting up.
The meeting lasted about 30 minutes and in the end Sergey left alone with the accused and Michaela having proceeded to Lagos.

---- Asked for what reason he had not previously remembered this meeting, given that he had said previously that that morning he had left the house by 10:00-10:30, he said now that on the date of the first interrogation he was "rattled" and had not remembered this fact.

---- To this point he wants to say that on the day prior to his interrogation he went to bed around 03:00, having up to that time accompanied officers of the PJ, namely Inspector Reis Sxxxxx, who invited him for coffee in the bar Bom Vivant, where they remained until about that hour he being certain that he was woken up at 07:00 when PJ officers went to his house.
So he had slept for only about 4 hours and was therefore very tired.

---- In truth after the meeting he proceeded with Michaela to Lagos, as he had affirmed in the previous interrogation.
He wants also to clarify in this interview that before they had gone to Francisco Pagarete's house they were both at Caixa Agr�cola [a bank in Portugal].
There the defendant made a cash deposit, of [English] pounds, into his account.
He does not remember the exact amount deposited but thinks that it would be about one hundred or so pounds.
In this interview [for the record] the defendant confirmed through the reading of a tally slip that that deposit was exactly an amount of 287.51 Euros.
He states that when he was in England he withdrew this amount, from an Automated Teller Machine (ATM), from an account of his or his mother's that he/she has in Lloyds bank with the objective of coming later to deposit it in his account at Caixa de Cr�dito Agr�cola.
Asked he states that usually he has with him debit and credit cards of his mother.

---- Later the defendant and Michaela went to the home / office of Dr. Francisco Pagarete, on foot, given that that residence is situated about 200 meters from the bank.
It would have been about 11:00-11:30 when he found Dr. Francisco Pagarete in his home.
Since he [FP] had not been telephoned by him [RM], using his mobile phone 91918xxxx, it was then agreed to meet later.

---- For reason of accuracy he now says that the meeting that happened afterwards was not with four persons but with five, that is Michaela, Jorge Sxxxx, Jason, another son of Jorge and the defendant himself.

---- Also he clarifies that before having been with Dr. Francisco, already during the afternoon, the defendant and Michaela went to collect Cxxxxxxxx at school who then accompanied them during all the rest of the day.
 He refers therefore that after having been with Dr. Francisco they did not go directly to the home of Michaela, having instead gone to the marina of Lagos where they had met again with Jorge Sxxxx, and his son where they continued the conversation about the company that they intend to make.
It was at this time that Cxxxxxxxx was allowed to play in an playground behind the caf� where they were.
He does not remember the exact time that they left the caf� but he knows that when they had left there the owners of the caf� where they had been closed the doors of establishment.
He recalls that he gave Jorge Sxxxx and his son a ride in his VW van to the bus stop located next to the post office, where they left them, the defendant, Michaela and Cxxxxxxxx having then proceeded to Michaela's house.
He remembers that when they arrived there Michaela began to prepare the dinner so it would have been about 20:00.

---- He states not being sure about having seen Lu�s arriving that night at Michaela's house.
He affirms that around 22:30-23:00 he left from the home of Michaela having gone directly to his home, that is to Casa LILIANA, where he will have arrived by 22:45-23:15.
He does not remember having stopped anywhere nor having spoken with anybody on that journey and he took the route that he usually takes passing by Intermarch� [a super/hypermarket chain in Portugal] and by the Total petrol station.
He is sure that he left the van parked in the street, that is in front of the house, because he always does that when he uses the van.
---- Again questioned, he states with absolute certainty that on the night of 02 May, after leaving the home of Michaela, he went directly to his home.
Once in the village of Luz he only stopped the car next to the gate and entered his home immediately.

---- Having been informed in this interview that around 15:44 on 02 May he made a telephone call to the number 91822xxxx, which corresponds to the phone of Dr. Francisco Pagarete, he confirms that in fact, before driving to his

[FP's] office/home, he [RM] had contacted him [FP] to know if he was there, [that] was what happened.
For the rest of what happened that day he confirms what he stated in the previous interrogation, reaffirming that in truth he spoke with his mother, who was still awake, and that he connected the computer having stayed awake until about 01:00-01:30.
In this regard he affirms it to be normal [usual] that his mother is still up until about 00:00-01:00, given that only after dealing with some tasks, namely feeding the cats and other chores does she go to bed.

---- He had states that on 02 or 03 May, in the afternoon, for matters related with business, he visited two apartments of the same owner, located at the foot of the "rotunda da bola" [football roundabout/traffic circle] in Lagos.
These visits lasted about 20 to 30 minutes and he did them together with Michaela.

---- He also wants now to amend what he previously said about what he did on 03 May.
 Once again he states that being tired and confused he had stated things that he now sees are not correct.
 He refers therefore that he will have got up at 08.00 having left home by 08:45.
He had already scheduled a business visit to a tourist complex called "Montinhos de Ouro", located in the region of Espiche, which he made in the company of Michaela.
So he went to collect Michaela at home, driving the VW.
He does not remember if he went up to Michaela's home.
He states that that morning they were both in his van at the complex where they had scheduled a meeting at a time he does not recall exactly but thinks it would be by 09:30.
---- They showed up at that location where they met with the father-in-law of the owner of the venture, whose name he does not remember, but knows that he is a builder in Lisbon, since she still had not yet arrived.
However the owner of the enterprise arrived and Michaela made conversation with her.
Later they went to lunch at the place mentioned in the previous interrogation after which they went to the marina in Lagos where they met with Jorge Sxxxx and his son.
Cxxxxxxxx did not accompany them this day.
They went to the Palmares Golf where they remained until the time came for them to go to pick up Chnstine, that is 15:00-15:30.
Again he gave a ride to Jorge Sxxxx and his son leaving them again at the bus stop next to the post office.
From there they proceeded to the school to pick up Cxxxxxxxx and the three went to Michaela's house having arrived by 15:45.
They were in Michaela's home until 19.30.

---- He states that about 19:30 he left the home of Michaela alone and went directly to his house. He took the same route the day before and is absolutely certain that he did not stop anywhere.

---- For the rest of what he said about this day during the 1st interrogation he maintains all its content.
He adds, however, that in the meantime he consulted on the Internet his mobile phone billing and found that on that night he made two calls which he had not remembered having made.
At 23:39 to the number of Sergey Malinca and another at 23:40 to the number of Michaela.
He does not remember, however, having made these calls nor having spoken to those people although he admits he had.

---- Further to what he said about Friday morning he intends to change the time that he woke up.
 In listings of his fixed phone it says that he made a call to Michaela at 08:27, which he presumes he must have done, despite not remembering the contents of the conversation nor even having made that call, and therefore he did not wake at 09:00 but before that time.

---- After the opportunity having been given to the defendant to amend facts and information that he had stated in the first interrogation, he was questioned about other matters.
---- In this interview the defendant was shown the list of contacts obtained from the calendar/address book of his mobile phone and PDA previously examined by the PJ, and he was asked to clarify who those people are which was done as follows:
